Advertising and Sponsorship

Law 162/2023 “On Social Communication” recognizes the practice of advertising and sponsorship across all formats, physical or digital, as part of the country’s social communication system.

Advertising is a form of communicative production with commercial purposes, carried out by the various legally recognized economic actors in the country as part of their marketing plans.

It respects the historical and cultural identity of the Cuban people, safeguards the values of socialist society, promotes inclusion, and supports both national interests and those of the diverse economic actors.

Advertising management contributes to the development of the economy and society, and pursues the following objectives:

  • Guide consumer behavior and foster a culture of responsible consumption
  • Enhance awareness and public image of products, services, brands, cultural assets, and tourist destinations
  • Enable the promotion of national products and services for export
  • Provide truthful data and information about the properties and advantages of a product or service, commercial brands, and other distinctive signs.

Sponsorship is a reciprocal relationship in which the sponsored party receives financial support, goods, or services from an individual or organization, and in return, the sponsor gains visibility and dissemination of their name, brand, product, or service.

Decree 102/2024, Regulations for the Practice of Advertising and Sponsorship, establishes the provisions that complement those endorsed in the Social Communication Law regarding the advertising and sponsorship of Cuban and foreign brands, products, and services in the national market.
